Voters in Saint Paul MN are collecting signatures on a petition (as an "initiative") to enact an ordinance allowing households in 1- to 4-unit properties the option to share a trash cart or dumpster, or to opt out;  thus Encouraging and Supporting Trash Reduction.

Proposing an ordinance to allow Residential Dwelling Units subject to Chapter 220 of the Saint Paul Legislative Code Entitled "Residential Coordinated Collection" to Share Service or Withdraw.

WHEREAS,

(1) Residential households and businesses in the City of Saint Paul MN have been required to have, and to pay fees and taxes for, unneeded and unused solid waste collection services;

(2) Exemptions from these requirements have been denied and/or restricted by the City regardless of whether a household or business can ensure that an environmentally sound alternative is used as provided in Minnesota Statutes Section 115A.941;

(3) When solid waste collection violations are found, the City, under Chapter 32 of the Saint Paul Legislative Code, has the authority to initiate and enforce collection service.


NOW THEREFORE, We, being registered voters of Saint Paul, Minnesota, petition the Saint Paul City Council to enact the following as an ordinance:

SECTION 1

The definitions in Chapter 220 of the Saint Paul Legislative Code apply to this chapter.

SECTION 2

a. Any RDU shall be automatically exempt from Chapter 220 and Section 357.05(g)(1) of the Saint Paul Legislative Code when the RDU property owner submits a declaration under penalty of perjury to the City stating any of the following:

1. That the RDU shares a cart with another RDU participating in Residential Coordinated Collection;

2. That the RDU property owner owns multiple RDUs that abut each other and contracts for residential dumpster service; or

3. That the property owner resides at the RDU and personally transports the waste to a licensed waste transfer station or another location authorized to accept waste generated by the property owner.

b. Billing must end on the next scheduled pickup date following delivery of the affidavit by hand, electronic means, postal service or carrier to the City.

c. RDUs shall not pay any fee for this exemption.

SECTION 3

This Ordinance shall take effect the later of: April 1, 2025, or date of enactment under City Charter Section 8.04.
